Terms & Conditions
Please read these terms carefully before booking a trek, tour, peak climb, or expedition with Bonny Himalaya Treks & Expedition (P.) Ltd.
These Terms & Conditions form a binding agreement between Bonny Himalaya Treks & Expedition (P.) Ltd. (“Bonny Himalaya”, “we”, “us”) and any person booking a trip through us (“you”, “the client”). By confirming a booking, you agree to be bound by the terms below.
-
01 Booking & Payment
A non-refundable deposit of 20% of the total trip cost is required at the time of booking to confirm your reservation. The remaining balance is due prior to departure, either by bank transfer or in cash on arrival in Kathmandu. Any bank transfer or payment processing charges are borne by the client. A completed booking form and a copy of your passport are required alongside your deposit.
-
02 Cancellation & Refund Policy
The 20% booking deposit is non-refundable once your trip is confirmed. If you need to cancel, please notify us in writing as early as possible. Cancellations made well in advance of departure may be eligible to have remaining payments (beyond the deposit) refunded or credited toward a future trip; cancellations made close to departure may not be eligible for any further refund, as permits, accommodation, and staffing costs are committed in advance. Where possible, we offer trip postponement to a later date in place of a cancellation, at no extra charge.
-
03 Trip Alteration & Itinerary Changes
Itineraries published on this site are a guide to the trip and may be adjusted before or during the trek due to weather, trail conditions, flight delays, permit restrictions, or the health and safety of the group. We will always aim to deliver a trip of equivalent value and experience if changes become necessary. Requests from clients to change dates, routes, or group size close to departure may be treated as a new booking and subject to availability and revised pricing.
-
04 Circumstances Beyond Our Control
Bonny Himalaya is not liable for cancellations, delays, or changes caused by events beyond our reasonable control, including but not limited to government restrictions, natural disasters, landslides, avalanches, extreme weather, political unrest, epidemics, strikes, or flight cancellations. Any additional costs arising from such events are the responsibility of the client. We strongly recommend comprehensive travel insurance to cover exactly these situations.
-
05 Travel & Medical Insurance
Comprehensive travel insurance is mandatory for all trekking, climbing, and expedition trips. Your policy must cover emergency medical treatment, high-altitude trekking or climbing (as applicable to your trip), helicopter evacuation and rescue, trip cancellation or interruption, and loss of or damage to personal belongings. Proof of insurance may be requested before departure. We are not responsible for costs arising from inadequate or absent insurance coverage.
-
06 Health, Fitness & Medical Disclosure
You must inform us in writing, before booking, of any medical condition, disability, or other factor that may affect your ability to safely complete the trip, particularly for high-altitude treks and climbing expeditions. We may request a medical certificate for certain trips. Undisclosed conditions that affect your safety or that of the group may result in exclusion from the trip without refund, at our reasonable discretion.
-
07 Passport, Visa & Permits
Clients are responsible for holding a valid passport, obtaining the correct Nepal entry visa, and meeting any other immigration requirements for their nationality. We arrange the necessary trekking permits, national park fees, and TIMS card (or restricted-area permits, where applicable) on your behalf as part of your trip package, based on the passport details you provide.
-
08 Client Conduct & Responsibility
Clients are expected to follow the reasonable instructions of their guide and crew regarding safety, pacing, and conduct on the trail. We reserve the right to remove a client from a trip, without refund, if their behavior endangers themselves, other participants, or staff. Clients are responsible for their own personal belongings throughout the trip.
-
09 Limitation of Liability
Bonny Himalaya and its staff will take all reasonable care in the preparation and operation of your trip. We are not liable for injury, illness, loss, or damage arising from circumstances outside our reasonable control, or from the inherent risks of trekking, climbing, and travel in mountainous and remote terrain. Nothing in these terms excludes liability that cannot be excluded under applicable Nepali law.
-
10 Governing Law
These Terms & Conditions are governed by the laws of Nepal. Any dispute arising from your booking or trip shall be subject to the jurisdiction of the courts of Kathmandu, Nepal.
